Рассматривается проблема полномочий арбитражных судов по предупреждению правонарушений в предпринимательской и иной экономической деятельности. Вопрос определения таких полномочий имеет ключевое значение для реализации задачи по предупреждению правонарушений в предпринимательской и иной экономической деятельности, стоящей перед арбитражными судами. Анализируя судебную практику и действующее законодательство, автор приходит к выводу о том, что в настоящее время недостаточно используется потенциал арбитражных судов в данном вопросе. Вместе с тем в качестве полномочий арбитражных судов, направленных на предупреждение правонарушений, автором статьи рассматриваются полномочия по определению предмета доказывания по делу, вынесению законного и обоснованного решения, принятию обеспечительных мер, а также полномочия по использованию не предусмотренного действующим АПК РФ института частного определения судьи. Также автор предлагает ряд законодательных изменений в АПК РФ, связанных с регулированием процесса принятия обеспечительных мер, дополнительным закреплением обязанности суда по определению предмета доказывания по делу и введением института частного определения в арбитражный процесс.
The article deals with the problem of authority of arbitration courts to prevent violations in business and other economic activities. The issue of determining these powers is crucial for the implementation of tasks for the prevention of offenses in entrepreneurial and other economic activities, which arbitration courts are facing. Analyzing the jurisprudence and the existing legislation, the author comes to the conclusion that currently the potential of arbitration courts is not used in the sufficient degree in this matter. However, as well as the powers of arbitration courts, aimed at preventing
crimes, the author of the article discusses the authority to determine the subject of proof in the case, the delivery of a lawful and reasonable decision, the application of preventative measures, and also the authority to use the institution of special judge determination which is not covered by the current Code of Arbitration Procedure of Russian Federation. The author also offers a number of legislative changes in the Code of Arbitration Procedure of Russian Federation related to the regulationmaking
process of preventive measures, additional security duty of the court to determine the subject matter of evidence in the case and the introduction of the authority to use the institution of special judge determination.
